Mediation and Alternative Dispute Resolution

1. Can ADR Really Help?

Absolutely. Sometimes, a dispute is not as complicated as we think, but our emotions get the better of us. Antwan Lawyers are very proactive with all forms of alternative dispute resolution (ADR) by allowing each party to access counselling and mediation prior to litigation.

2. How Can ADR Work?

Mediation is often a good way for each party to convey to the other what they want to achieve. Mediation involves having a third party present to control the discussion. This third person, is usually a qualified mediator or ADR officer whom has experience in trying to resolve your matter without you having to resolve to litigation.

Having a third party present who does not make any judgement is a useful tool for the parties to navigate through their emotions, to get to the point and deal with the dispute in a constructive and a healthy manner.

3. Added Benefits of ADR.

The most important factor to note is that mediation can also be cost effective and quick way of dealing with a dispute, than through Court proceedings.

A Mediation or ADR requires the cooperation of both parties and it may still involve some costs. However, these are usually significantly less that Legal proceedings. It is important that the parties agree on the mediator whose services they want to ensure that they are both comfortable with them and that they agree to share the fees.

4. Are There Any Exceptions?

Yes. Mediation and ADR is usually not recommended in circumstances where there is family violence or abuse.

5. What Happens if Medication or ADR works?

When counselling, ADR and/or mediation leads to resolution, then the agreement can be formalised and registered with the Family Court of Australia or the Federal Circuit Court of Australia as consent orders. The consent order will finalise the matter, either on an interim or a final basis, depending on the needs of the parties.
